ORDINANCE TO ADOPT SECTION 2-258 OF THE CODE OF ORDINANCES
OF THE CITY OF MENOMINEE, MICHIGAN, AMENDING THE DOWNTOWN
DEVELOPMENT AUTHORITY DISTRICT BOUNDARIES
Sec. 2.11 (7), of the Code of Ordinances of the City of Menominee, Michigan (Code or Ordinances), requires action by the City of Council in the form of an ordinance if the action amends or repeals any ordinance previously adopted.
The City of Menominee ordains:
Sec. 2-258. Extended Downtown District; Extended DDA Area.
(a) Establishment. A downtown district of the City of Menominee Downtown Development Authority (the DDA) is established and known as "Downtown Development Area No. 3" and encompasses the following described property located in the City of Menominee, Menominee County, State of Michigan:
All in Section Two (2), Township Thirty-one (31) North, Range Twenty-seven (27) West, City of Menominee, County of Menominee, State of Michigan.
Commencing at the intersection of the South right-of-way of Tenth (10th) Avenue and the West right-of-way of First (1st) Street;
Thence Southeasterly along said West right-of-way of First (1st) Street to the Southeast corner of Lot 2 of Block 1 of Nicholas Gewehr’s Addition to the City of Menominee;

(b) Findings with respect to plan. The development plan, entitled the "Downtown Development Area Plan" for downtown Development Area No. 3 (the plan) constitutes a public purpose and the following findings are made with respect thereto:
(1) The plan meets the requirements of Public Act No. 57 of 2018 (MCL 125.4201 et seq.), including specifically section 217(2) of such Act (MCL 125.4217(2));
(2) The proposed method of financing the public facilities identified in the plan is feasible and the downtown development authority has the ability to arrange the financing as described in the plan;
(3) The development described in the plan is reasonable and necessary to carry out the purposes of Public Act No. 57 of 2018 (MCL 125.4201 et seq.);
(4) The plan is in reasonable accord with the City's master plan;
(5) Necessary public services including fire and police protection and utilities are adequate to service Downtown Development Area No. 3;
(6) No changes in zoning are required to implement the plan; and
(7) Changes in streets and utilities required to implement the plan are identified in the plan and are reasonably necessary to implement the plan and for the City.
(c) Approval of plan. The plan is hereby approved.
(d) Effective date. this Ordinance and the related rules, regulations, provisions, requirements, orders and matters established shall take effect upon publication and the expiration of twenty (20) days after adoption.

I, hereby certify that the foregoing ordinance is a true and complete copy of that adopted by the City Council of the City of Menominee, County of Menominee, State of Michigan, at a meeting held on October 19, 2020, the original of which is on file in my
office and available to the public. Public notice of said meeting was given pursuant to and in compliance with the Open Meetings Act, Act No., 267 of the Public Acts of Michigan 1976, including in the case of a special or rescheduled meeting, notice by
posting at least eighteen (18) hours prior to the time set for said meeting.
